Banuelos v. Time Warner, Inc.: The Trial judge found “no industrial causation” after client passed away from colon cancer.

The trial judge found “no industrial causation” after Mr. Banuelos passed away from colon cancer, notwithstanding he had worked for Time Warner Cable and its associated companies for approximately 27 years repairing radio frequency leakage. The WCAB reversed the trial judge decision and awarded compensation to the family based on the fact that the medical evidence, within reasonable medical probability, provided a nexus between Mr. Banuelos’ work and the cancer, even though there was not necessarily definitive scientific research showing a connection between the cancer and the relatively new technology.
